It’s just awesome.
The elephant in the room with Donald Trump both during the campaign and now, as he transitions into the White House, is his ability to name the court pick to fill Supreme Court Associate Justice Antonin Scalia’s shoes.
But that’s not the only court he gets to influence, you know. Indeed, Trump is going to be able to nominate and name more than 100 judges to different federal court spots throughout the country.
And liberals are nervous, particularly with their go-to reliable, the Ninth Circuit Court of Appeals.
There, Trump will be naming four to fill some long-standing vacancies.
“‘Outgoing Sen. Barbara Boxer (D-CA) called the vacancies a “judicial emergency,’ according to Bay Area public radio station KQED, even though there are 29 judges on the court. The ’emergency’ is that Trump’s nominees might be able to make the court more conservative,” Breitbart reported.
The Ninth Circuit has traditionally been the West Coast’s long-time liberal friend. It’s decisions have been frequently on 5-4 lines, however. And that’s what has Democrats worried.
“Liberals are worried about that increasing ‘moderation’ at the Ninth Circuit. KQED interviewed University of Richmond law professor Carl Tobias, who commented: ‘I think even in the Obama years the court has moved to be more moderate than it used to be, so I think that with those four appointments it could make some difference and move the court further in that direction.'”
Oh, this is just too good to be true.
If Trump gets a hardcore constitutionalist of the ilk of Scalia on the Supreme Court, and several more of limited government outlook on the seats at federal courts nationwide, that’s a huge gain. But changing the political makeup or ideology of the long-time liberal-leaning Ninth Circuit?
That’s a dream come true – and a wild dream at that.
